Candidate Privacy Policy
1. OVERVIEW
1.1 Internet Services Australia 1 Pty Ltd (“THE ICONIC”, “we” or “us” ) collects information from individuals as part of its recruitment and selection process, when engaging individual contractors and when onboarding workers employed by our labour hire agencies (“Candidates and Contracted Personnel”, “you” or “your”). 1.2 THE ICONIC is committed to protecting your privacy. THE ICONIC is bound by the Privacy Act 1988 (Cth) (Privacy Act), which sets out a number of principles concerning the protection of your personal information known as the Australian Privacy Principles (APPs).
1.3 All applications for employment, contracting and labour hire arrangements with or involving THE ICONIC are treated as confidential in accordance with the Privacy Act.
1.4 THE ICONIC is a subsidiary of Global Fashion Group S.A (“GFG”) and together with other subsidiaries of GFG (“Group Companies”) forms part of the “GFG Group”.

2. DEFINITIONS
2.1 Personal Information: information relating to an individual, including an opinion, which may be provided to THE ICONIC in the process of engaging with Candidates and Contracted Personnel either in material or not, and whether true or not. Such information may personally identify an individual or make the person’s identity reasonably apparent.
2.2 Sensitive Information: information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences, criminal record or health information.
3. YOUR PERSONAL AND SENSITIVE INFORMATION
3.1 This Recruitment Privacy Policy relates to Personal Information and Sensitive Information of a Candidate or Contracted Personnel collected by any means for the purpose of THE ICONIC’s recruitment, contracting or labour hire processes.
3.2 If a Candidate or Contracted Personnel does not provide their personal and/or sensitive information, THE ICONIC may, or will, be unable to progress a Candidate’s application or offer of employment or Contracted Personnel's contracting arrangement, or to consider a Candidate or Contracted Personnel for future opportunities.
3.3 Personal information collected during our recruitment, contracting or labour hire processes may include:
3.3.1 identification information, such as your name, postal or email address, telephone numbers, licenses, date of birth, gender details;
3.3.2 other contact details such as social media handles you use on recruitment websites;
3.3.3 resume, background information or other correspondence;
3.3.4 work history and education history;
3.3.5 health information, disabilities and psychometric testing results;
3.3.6 other information THE ICONIC considers necessary to our recruitment or labour hire processes.
3.4 Sensitive Information may be required to be collected in some circumstances. THE ICONIC will only collect Sensitive Information if it is necessary for business purposes and for the inherent requirements of the position. Sensitive health information will only be collected with your consent.
3.5 All information collected will be used and disclosed by THE ICONIC only as outlined in this Recruitment Privacy Policy. THE ICONIC takes reasonable steps to ensure that any Personal Information and Sensitive Information of a Candidate or Contracted Personnel is held securely.
4. HOW WE COLLECT YOUR PERSONAL INFORMATION
4.1 THE ICONIC will collect Personal Information about Candidates and Contracted Personnel:
4.1.1 in the case of individuals applying for employment or contracting directly with us, directly from such candidates and contractors. For example where a Candidate provides information by applying to a printed or online advertisement or submitting information through our careers portal https://www.theiconic.com.au/opportunities/;
4.1.2 where relevant, and with the Candidate or Contracted Personnel's consent, through a third party recruitment service provider or labour hire company;
4.1.3 from third parties, with a Candidate or Contracted Personnel's consent. For example, THE ICONIC may seek information about a Candidate or Contracted Personnel's:
4.1.3.1 prior employment history through reference checks;
4.1.3.2 eligibility to work in Australia through a visa status check;
4.1.3.3. educational qualifications by requesting confirmation of qualifications or results from an academic institution;
4.1.3.4 aptitude or other psychometric testing;
4.1.3.5 ability to perform the inherent requirements of the position, through medical and other allied health professionals, or criminal record history check and/or working with children check;
4.1.3.6 from speaking to THE ICONIC over the phone;
4.1.3.7 through publicly available networking sites, such as Facebook or LinkedIn.
4.2 We may also collect information about you because we are required or authorised by law to collect it.
4.3 In the case of individuals applying for employment with us, if your application is successful and you are offered employment with THE ICONIC, as a condition of employment we will ask you to provide evidence of your identity and legal entitlement to work in Australia. We will also ask for Personal Information, such as emergency contact details, tax file number and bank account details which will form part of your employee file.
4.4 If THE ICONIC does not have the prior consent of a Candidate or Contracted Personnel to collect Personal Information from a third party THE ICONIC will take reasonable steps to inform the Candidate or Contracted Personnel that it has collected Personal Information from a third party.
5. HOW WE USE YOUR PERSONAL INFORMATION
5.1 Personal Information of a Candidate or Contracted Personnel may be used in order to:
5.1.1 in the case of individuals applying for employment with us, assess a candidate’s application (or an application submitted on the candidate’s behalf by a recruitment service provider) for advertised employment or contracting positions;
5.1.2 invite you to apply for future positions of interest with THE ICONIC, or GFG Group, unless you notify us that you do not wish this occur. If you do not wish to receive information about future employment opportunities, please contact us via https://www.theiconic.com.au/contact/;
5.1.3 assess the provision of Contracted Personnel provided by a labour hire company under contract and for compliance with applicable laws;
5.1.4 for THE ICONIC, or Group Companies statistical reporting and analysis in relation to recruitment
5.1.5 in connection with THE ICONIC management of any business risks, investigation, resolution and defence of complaints of legal claims, compliance with court orders and other legal obligations and regulatory requirements associated with the recruitment process.
5.2 In the case of individuals applying for employment with us, if you are successful in securing a position with THE ICONIC we may also use your Personal Information for employment-related administrative purposes.
5.3 In the case of individuals contracting directly with us, if you are successful in securing a contracting position we may also use your Personal Information for contract-related administrative purposes.
5.4 Unless authorised by the Privacy Act, the Personal Information of a Candidate or Contracted Personnel will not be used for any other purpose without a Candidate or Contracted Personnel's consent.
6. WHEN THE ICONIC MAY DISCLOSE YOUR PERSONAL INFORMATION
6.1 THE ICONIC may disclose your personal information to Group Companies or GFG Group for the purposes of:
6.1.1 enabling them to consider you, and contact you, in relation to future positions of interest with THE ICONIC Group Companies or the GFG Group;
6.1.2 statistical reporting and analysis in relation to recruitment, contracting and labour hire arrangements;
6.1.3 THE ICONIC Group Companies or the GFG Group may need to disclose the Personal Information of a Candidate or Contracted Personnel to organisations outside THE ICONIC, including organisations located outside of Australia, for the purposes outlined in section 5 of this Recruitment Privacy Policy. THE ICONIC takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your Personal Information. These organisations may carry out:
6.1.3.1 information technology services;
6.1.3.2 website usage analysis;
6.1.3.3 management and administrative tasks.
6.2 THE ICONIC may disclose your Personal Information to recipients outside of Australia. Those recipients are likely to be located in the United Kingdom, the United States, Luxembourg, Germany, Japan, Singapore and other countries or jurisdictions depending on the nature of the services those recipients provide to us.
7. ACCURACY AND STORAGE OF PERSONAL INFORMATION HELD
7.1 THE ICONIC will endeavor at all times to maintain an accurate record of the Personal Information of each Candidate or Contracted Personnel.
7.2 To assist THE ICONIC to keep its records up to date, Candidates and Contracted Personnel should ensure all Personal Information provided to THE ICONIC is accurate and up to date, and to notify THE ICONIC of changes where appropriate.
7.3 Personal Information held by THE ICONIC will be stored and managed in accordance with our https://www.theiconic.com.au/privacy-policy/.
8. CANDIDATES CAN ACCESS THEIR PERSONAL INFORMATION
8.1 Candidates and Contracted Personnel may request access to information that THE ICONIC holds about them by contacting the Privacy Team via https://www.theiconic.com.au/contact/.
8.2 If the Personal Information held is incorrect, Candidates and Contracted Personnel may request that THE ICONIC amend our records by contacting the Privacy Team via https://www.theiconic.com.au/contact/, and THE ICONIC will take reasonable steps to do so.
8.3 THE ICONIC may make reasonable changes for access to information and may refuse to provide access to, or delete, information where this is required or authorised by the Privacy Act or another law.
